SA 2010 Week 4: Services and Investment - Rule-making, Market Opening and Litigation

This course starts with an in-depth examination of the law and economics of trade in services at both the multilateral and regional levels and addresses key outstanding sectoral and rule-making challenges in services negotiations. The course then focuses on the rapidly evolving landscape of investment rules and litigation under bilateral investment treaties and preferential trade agreements. It also explores prospects for the development of a truly multilateral regime for investment.

Trade in Services
• To highlight the conceptual complexities of liberalisation of trade in services.
• To gain a keener understanding of how the economic characteristics of services transactions have shaped the law of services trade.
• To assess the contribution that services can make to economic development.
• To explain current patterns of commitments across countries, sectors and modes of supply.
• To understand the legal architecture of the General Agreement on Trade in Services
• To differentiate between general obligations and specific commitments and between the four modes of supplying services.
• To understand the various departures from MFN treatment allowed under the GATS and the policy rationales behind such flexibility.
• To understand the unfinished rule-making agenda under GATS (emergency safeguards, subsidies, government procurement and domestic regulation).
• To assess the treatment of services trade in preferential trade agreements (PTAs) and the systemic implications of GATS+ advances in PTAs.
• To explore whether and how some issues and sectors may be more suitable to preferential as opposed to multilateral policy approaches.
• To understand the nature and effects of existing multilateral disciplines applied to preferential agreements in services trade.
• To study trends in dispute settlement in services trade and the reasons behind the limited jurisprudence to date
Investment
• To get a clear vision of the incipient network of rules governing investment at the bilateral, regional and multilateral levels.
• To get a clearer understanding the law of international investment: the scope and nature of key substantive provisions in investment agreements.
• To understand the issues arising in the negotiation and application of the definition of the terms “investment” and “investor” in international investment agreements.
• To clarify the different dimensions of the scope of application of international investment agreements.
• To develop the conceptualization and distinction between absolute standards of protection and relative standards of treatment to investors and investments.
• To discuss and analyze the complexities related to the drafting, negotiation and application of clauses related to investment protection such as, inter alia, non-discrimination, minimum standards of treatment, expropriation, transfers and umbrella clauses.
• To get a clear vision on the key trends and the legal implications of investment litigation under BITs and PTAs
• To understand and analyze the evolution of the resolution of disputes in the investment field, both State-to-State and Investor-State .
